Shitfuck is a very strange individual. On the one hand, he often talks
at length about how he wants to spread freedom around the world. But on
the other hand, he was taking away our freedom here in America. I do not
know what Shitfuck thinks "freedom" is, but I do know it is not what he
thinks it is. The Vizzini of Presidents. The most obvious and egregious
abuse of power and suppression of American freedoms was Shitfuck's
secret illegal wiretaps on American citizen's telephones.
It is
not illegal for the government to tap your phone and listen to your
phone calls, although it is a tremendous invasion of privacy that should
be regulated carefully and conducted sparingly. Wiretaps are illegal,
however, when they are done without a search warrant. There is no
exception to this, there is no way around this, and anyone who tells you
there is is wrong. Wiretaps are classified as a "search and seizure" of
your property. Search and seizure is strictly regulated in the U.S.
Constitution by the Fourth Amendment:
"The right of the people to be secure in their persons, houses,
papers, and effects, against unreasonable searches and seizures, shall
not be violated, and no Warrants shall issue, but upon probable cause,
supported by Oath or affirmation, and particularly describing the place
to be searched, and the persons or things to be seized."
Some like to parse various semantics, and there are rules regarding
consent and other common law provisions allowing various types of
searches, but the bottom line is: if the government is tapping your
phone without a warrant, someone in the government is committing a
crime. One thing that I always found interesting about Shitfuck and his
friends in the Republican Party was how much they indulged in the type
of semantic, "it depends on what the meaning of is, is" arguments such
as they spoke out so forcefully against when President Clinton indulged
in them. Simply put, only a Constitutional Amendment can deprive you of
your Fourth Amendment rights or any other of the personal protections
afforded by the Bill of Rights.
Despite the strong protection
provided by the Constitution, Congress has enacted laws that may
contradict the 4th Amendment. The Foreign Intelligence Surveillance Act
of 1978 (FISA) allowed the government to perform warrantless wiretaps of
suspicious foreign communications. It included the ability for the
government to seek a warrant from a secret court even after the actual
wiretap was committed. I hold my protections under the Bill of Rights
very dear, and do not believe even this limited exception to the 4th
Amendment is Constitutional. So I was absolutely incensed to learn that,
starting in March 2002, Shitfuck and his cronies had abused FISA,
tapping phones and searching phone records of millions of Americans
without a warrant. To justify this abuse of power, Shitfuck and his
Justice Department claimed special powers for the President which are
not enumerated by the Constitution and, therefore, do not exist. The
entire operation is highly classified and Shitfuck's only public regret
for his blatant stomping on our freedoms was to say he wished the media
had not revealed he had been doing it. What a fucking asshole.
I
know many are frothing at the mouth reading this, asking why I would
put America at danger by requiring a warrant. To these I say: fuck you.
Go move to Russia and tell Vladimir Putin he can search your ass day and
night. I am not a terrorist, I love my country and refuse all illegal
searches. Again: if the government has reason to believe someone's phone
should be tapped, then ask for a warrant. The secret FISA court
approved nearly all requests for warrants, even those requested after
the wiretap occurred. It is not an unreasonable thing to require in
exchange for violating people's privacy (evidence shows that NSA
employees involved in the wiretap listened to phone sex conversations
and other personal matters as part of this illegal activity).
Additionally, any evidence obtained by illegal searches is not
admissible in a court of law. So a prosecutor could be trying to put a
known terrorist in prison, and the case could be thrown out because
evidence was obtained by an illegal wiretap. It remains to be seen how
many evildoers will be set free because of tainted evidence obtained by
Shitfuck's illegal program, but even one would be too many. The 4th
Amendment protects us from tyranny. If you like tyranny then you are
certainly welcome to waive your Constitutional rights. As for myself, I
will stick with my boy Christopher Gadsden and say, "Don't Tread On Me."
