Look I will be really frank. I don't have any sympathy for terrorists,
at all. That doesn't mean that they shouldn't get the right of habeas
corpus. Granting habeas rights to terrorists (allowing them to challenge
their detention in a court of law, for example) is not about being soft
on terror. It is about everyone who is not a terrorist. In other words,
almost everyone. Take away habeas and you have no rights. If you do not
have the power to tell a court why you should not be in prison, then
the government can put you in prison and you are trapped there, forever.
It doesn't matter if you are the best person in the world, never commit
a crime, fly the flag with pride, love America, and hate its enemies.
Without the writ of habeas corpus, you can be placed in a prison cell
and they can throw away the key. Your innocence is irrelevant and the
only thing that can save you is the whim of the government that locked
you up.There are arguments for temporarily suspending the writ of habeas corpus in times of great crisis; Abraham Lincoln and Franklin D. Roosevelt both did it, and they are otherwise regarded as among our greatest Presidents. I believe that if anyone is so clearly a terrorist and enemy of the Nation that they could be locked up without question, then they likewise would be ordered held without bail by a judge. If you don't have the evidence to convince a judge, how can you say you have evidence to convince yourself? The Guantanamo Bay Detention Facility has held individuals classified as "enemy combatants" by Shitfuck since the "War on Terror" began. Shitfuck said that these individuals are not protected by the Geneva Convention, and at least some of them were subjected to torture including the controlled drowning prodcedure euphemistically known as "waterboarding". Several Supreme Court decisions have upheld the right of these individuals to habeas protections. Shitfuck has claimed to all who would listen that the real reason the terrorists hate us is because they hate our freedom. But the Guantanamo Bay Detention Facility is a slap in the face to all freedom and liberty loving people, in America and everywhere.
